중국의 이원적 토지소유 구조 하의 소재산권 주택(小产权房) 문제 연구

Abstract

In the suburbs of China, there are house of limited property rights formed between the legitimate and the illegal areas. The government has defined this as illegal, but the central government is conducting an experiment for creating an appropriate policy measures by establishing an housing mediation website in Shenzhen. House of limited property rights has a lot of conflicts because various stake holders are intertwined. At present, the Chinese government has only proposed a policy direction of 'two-way policies’, but has not yet presented concrete measures. The issue of the house of limited property rights is an 'inevitable' product, which was caused by the urban development process of 'dual-land ownership structure'. North Korea also has a dual land ownership structure similar to that of China, and the China's experiences give good implications to North Korea. In this context, this paper analyzed the formation mechanism of China's house of limited property rights, the characteristics of property rights and the policy responses, and finally has derived some implications from the experiences of China.
