시동잠금장치 프로그램 시행과 관련된 논점 및 입법 방향 ― 스웨덴의 비전 제로 정책의 취지 도입 필요성 및 이러한 취지에 기초한 시동잠금장치 프로그램 도입이 갖는 의미의 검토 ―

기존의 형사법적, 행정적 대응으로는 음주운전으로 인하여 발생하는 폐해를 방지하기에 충분하지 않다는 사실이 밝혀지고 있다. 이에 따라 음주운전자에 대하여 운전면허 재취득 내지 유지의 요건으로 음주시동잠금장치를 설치하도록 하는 제도를 도입하는 국가가 증가하고 있으며, 우리나라에서도 이 제도의 도입이 논의되고 있다. 이와 관련하여 개인의 자유를 보장해 주기 위하여 제한적으로 음주시동잠금장치를 도입하는 것이 타당하다는 주장도 제기되고 있으나, 교통안전과 관련된 정책을 결정함에 있어서는 근본적으로 스웨덴에서 시작된 비전 제로 정책의 바탕에 놓인 이념을 받아들여서 교통참여자의 안전을 최우선 과제로 설정하는 것이 타당하다. 그리고 음주운전이 만연한 현실이나 시동잠금장치의 사용이 운전 자체를 허용하면서도 음주 후 운전이 이루어지는 것을 효과적으로 방지할 수 있는 장치라는 점 등을 고려한다면 음주운전 문제에 효과적으로 대응하기 위하여서는 시동잠금장치 제도를 폭넓게 도입하는 것이 바람직할 것이다. 즉 행정 모델의 형태로 입법화하여 상습 음주운전자, 단속 당시 혈중알코올농도 수준이 높았던 운전자, 연령이 낮고 운전경험이 많지 않은 음주운전자 등 음주운전으로 인하여 중대한 법익침해를 야기할 수 있는 운전자에 대하여 당사자의 희망 여부를 묻지 아니하고 시동잠금장치 설치를 강제하는 것이 타당하며, 이외에도 화물자동차, 통학차량, 위험물질 운반 차량 등에 대하여서도 장치를 설치하도록 하는 것이 적절할 것이다.
Abstract
Drunk driving is a serious problem. Many different types of sanctions such as fines, imprisonment, suspension or withdrawal of the driving license have been put into practice to prevent drunk driving, but proved only partially successful. Most of all, they are not effective to change the behavior of those who are alcohol dependent. Alcohol interlock programs are now regarded as one of the most promising measures to prevent drinking and driving. This article proposes that the philosophy of the Swedish Vision Zero policy should be adopted in designing the road transport system. That is to say, it should be assumed that “it can never be ethically acceptable that people are killed or seriously injured when moving within the road transport system” and, in this regard, it is urgently needed to introduce the alcohol ignition interlock program to increase road safety and thereby protect road users. In legislating alcohol interlock program, it would be a better choice to introduce a mandatory administrative model that require all high-risk drunk drivers such as repeat offenders, High BAC offenders, and young drivers with less experience to install an alcohol ignition interlock device regardless of their consent. It is also recommended to mandate vehicles like school busses, commercial trucks, and vehicles carrying hazardous materials be fitted with an alcohol ignition interlock device. Considering that the problem of alcohol related traffic accidents is very severe and alcohol interlock programs offer offenders a possibility to continue driving, the mandatory administrative model of alcohol interlock program would not be found to violate the fundamental rights of the drunk drivers. However, it would be better to limit the administrative discretion to extend the duration of an alcohol interlock program participation to avoid any constitutional issues that may rise regarding the length of participation in the program.
