Abstract
The objective of this study is to consider “Paramount Case”historically and legally up to 1990s. On 3 May 1948, the U. S. Federal Supreme Court found that theParamount dependents who were Hollywood studios violated ShermanAct by vertical integration, blocking booking and so on. The court alsoordered the Paramount dependents to prohibit from their activitiesunreasonably restraining competition, and to divest five major studiosof theaters. According to the court decision, each of the Paramountdependents finally signed the Paramount consent decrees. Under the Paramount decision, Hollywood studio system wasweakened and studios decreased film production and concentrated ondistribution instead in the decline of a motion picture industry. Withmore independent film makers entering the film industry than before, the number of independent films with value produced outside of studioswere increased. Under Reagan's laissez-faire attitude in 1980's, the U. S. Department of Justice (the “DOJ”) reviewed the Paramount decrees anddeclared that it would no longer enforce the decrees due to the criticalchange in the film industry. The Paramount dependents sought to petition for relief or termination of the decrees with the support of DOJ. The court vacated the Loew's original consent decrees and otherrestrictions in 1992. The vertical integration in the film industry hasbeen officially approved in the United States till now. Economists, especially the Chicago school, have criticized theParamount decision sharply arguing that the divorcement resulted in thedecline of the film industry through decreasing studio's efficiency andbusiness profit. They, however, ignored a very positive contribution tothe progress of the cinema in the United States. It cannot be said that the contemporary vertical integration meansoverturning the 1948 Supreme Court ruling or devaluates the value ofthe Paramount decision.
