성범죄 피해자 진술신빙성과 피고인 처벌 판단에 성차별의식과 강간통념이 미치는 영향

성범죄 피해자 진술신빙성 판단에 있어 ‘피해자다움’에 대한 사람들의 편견과 성차별적 태도에 대한 연구는 여전히 부족한 실정이다. 본 연구는 피해자의 진술일관성과 피해자다움, 피고인과의 관계에 따라 피해자의 진술신빙성과 책임에 대한 판단, 피고인의 유무죄 및 처벌수준 판단에 차이가 있는지를 조사하였다. 또한 피고인 처벌과 피해자 책임 판단에 있어 성차 및 연령차를 조사하고, 양가적(적대적, 온정적) 성차별의식과 강간통념이 미치는 영향을 알아보았다. 법학전문대학원에 재학 중인 600명(남 328명, 여 272명)을 대상으로 성범죄 사건을 바탕으로 구성한 설문조사를 실시하였다. 그 결과 응답자들은 피해자의 진술일관성이 낮은 경우보다 높은 경우에 진술신빙성을 더 높게 판단하였으며, 피고인을 유죄로 보고 더 무겁게 처벌해야 한다고 평가하였다. 피해자가 전형적인 피해자다움에 대한 기대에 부합할 경우 그렇지 않은 경우보다 피고인을 더 무겁게 처벌해야 한다고 평가하였으며, 피고인과 모르는 사이일 때보다 아는 사이일 경우 피해자의 진술신빙성과 피고인의 처벌수준을 더 낮게 평가하였다. 조절효과 분석 결과, 남성이 여성보다 피해자의 책임을 더 크게 판단하였는데, 적대적 성차별의식과 강간통념 수용도가 높을수록 그 경향이 두드러졌다. 피해자 진술일관성이 높은 경우 피고인의 유죄 판단 가능성이 높아지는데, 강간통념 수용도가 높으면 이 영향을 감소시켰다. 남성이 여성보다 피고인 처벌수준을 더 낮게 판단하는데, 피해자의 진술신빙성이 높으면 그 경향이 감소하였다. 마지막으로 형사사법 절차에 대한 본 연구의 의의 및 후속 연구에 대해 논의하였다.
Abstract
The research is scarce on the influence of victim stereotypes and sexism on the judgment of rape victim statement reliability. This study investigated difference in the judgment of rape victim statement reliability, guilty of the accused, offender sentencing, and victim responsibility by victim statement consistency, victim stereotypes, and offender-victim relationships. Also, the study examined difference by gender and age in the judgment of offender punishment and victim responsibility, and influence of ambivalent(hostile, benevolent sexism) and rape myths acceptance. Six hundred law school students(328 males, 22 females) completed rape vignettes. As a result, victim statements were evaluated more reliable and the accused was more likely to be judged guilty and highly sentenced when victim statements were highly consistent. The accused was more likely to highly sentenced when victim conformed to the stereotypes of an ideal victim, and victim statement reliability and offender punishment was evaluated to be lower when victim and offender knew each other. Moderational analyses showed that the tendency of males than females evaluating the victim more responsible became stronger with high level of hostile sexism and rape myths acceptance. The influence of high consistency of victim statement on the guilty judgment of the accused was lessened with high level of rape myths acceptance. The tendency of males than females with less severe punishment was lessened when victim statements were highly reliable. Finally, the implications for the criminal justice system of the study and further studies were discussed.
