본 연구는 최근 급증하고 있는 아동･청소년 대상 성범죄 처벌에 대한 사회･도덕적 인식과 견해의 차이가 주목 받으면서 아동･청소년이 성적 자기결정권을 행사할 수 있는 연령에 관한 과학적이고 합리적이며 현실적인 근거를 제시하고자 시도되었다. 아동･청소년의 성적 자기결정능력을 측정하기 위하여 선행연구와 UNESCO가 제안하는 성교육 가이드라인에 근거로 하여 성적 자기결정권을 발휘하기 위해 갖춰야 할 항목을 도출하고, 전국 현장에서 아동･청소년 성교육 및 성 상담과 관련된 업무를 담당하는 실무자와 전문가 218명을 대상으로 설문조사법의 형식으로 각 항목에 대하여 평가하도록 하였다. 조사 결과, 현장 실무자와 전문가는 50% 이상이 아동･청소년은 성별과 관계없이 최소 만 15세 이상은 되어야 성적 자기결정능력을 갖췄다고 볼 수 있는 것으로 평가하였다. 본 연구는 아동･청소년의 성 보호를 위해 더욱 현실 반영적인 평가를 통하여 그들의 성 의식 수준을 검증함으로써 성적 자기결정성에 대한 사회적 인식과 법 감정을 조성할 과학적 근거자료로 활용 가능함을 시사한다.
Abstract
This study aims to estimate the age that children and adolescents have the capability for sexual self-determination in Korea. The age has been continuously discussed with regard to sexual crimes targeting children and adolescents and therefore, it is strongly essential to provide scientific and reasonable evidence for the age related to sexual self-determination capability of children and adolescents. We developed a scale to measure children’s and adolescents’ sexual self-determination capability based on empirical studies and UNESCO’s international guidelines on sexuality education. A survey for the developed scale was conducted for 218 experts in the various fields connected to sexual educations of children and adolescents. As results, the experts estimated that children and adolescents might have sexual self-determination capability approximately when they are 15 years old and above. The study highlights the necessity that policy makers, lawmakers and educators should have more foundational counterplan to protect children and adolescents from sexual crimes.
