유럽민사법의 “공통기준참조초안(DCFR)”상신탁종료규정에 관한 고찰

Because of the flexibility of trust system, the demand for transaction systems is increasing day by day. Forthis reason, the unification and modernization of the Trust Law have been going on in various countries of theworld including Japan, to a greater or lesser degree. Such as this flow, the European Union was launchedunification of civil law. The result is a DCFR. And the trust was defined to the 10th Book. DCFR Trust isone that was born in an effort to try to keep the content and nature based on the trust of Anglo-Americanlaw. Above all things, it is the provisions of the Trust law having a good understanding of the Trust Law ofBritain and the United States from the continent legal viewpoint. The purpose of this study is examining and analyzing A termination of a trust under the DCFR Trust ⅩBook Chapter 9 Section 1. This paper is composed of Termination rights holder and its requirement(Ⅱ), andthe effect of termination(Ⅲ). In addition, the extent necessary, Comparative legal reviews is examined.
