이 논문은 중국 법원제도의 가장 심각한 문제로 제기되는 법관의 대중화(大衆化) 문제를 분석하는 것이다. 이를 통해 1999년부터 지금까지 10여 년 동안 중국이 추진하고 있는 법원개혁의 내용과 성과를 이해하려고 한다. 이 논문은 먼저 법관 대중화의 실태, 원인, 문제점을 분석한다. 또한 법관의 대중화 문제를 해결하기 위해 그 동안 중국학계와 법조계가 제기한 해결 방안 즉, 법관의 직업화(職業化)를 분석한다. 이후에, 제1, 2, 3차 <법원개혁 요강>이 제기한 법관제도의 개혁 정책과 이것이 각 지방에서 실제로 어떻게 실시되고 있는가를 몇 가지 사례 분석을 통해 검토한다. 결론에서는 법관제도의 개혁을 평가하고 향후 해결 가능성을 전망한다.
Abstract
This article aims at analyzing the non-professionalization of judges as the most serious problem in the Chinese judicial system. By this way, it makes an attempt to understand the policies and achievements of China’s court reform which China has implemented for the past decade since 1999. This paper first investigates the realities, causes, and problems of non-professionalization of judges. Then it examines the professionalization of judges, a measure argued by academics and juries in China as a solution to the problem. Third, this article delves into the concrete policies of the Outline of Court Reform and its implementation in the local levels, focusing on several cases. Finally it assesses the results of court reform and the possibility of the reform’s success.
