The radio frequency spectrum is a vital and limited national resources. In today's era of modern broadcasting and communications, Spectrum contributes to medical service, public welfare, transportation infrastructure, public safety, job creation, and economic growth, and it enables us to promote ubiquitous information society. However, access to this spectrum resources can be artificially restrained when spectrum management policies fail to keep pace with advances in spectrum technologies. The rapid growth in demand for radio frequency spectrum causes increase in radio spectrum management costs, and funds for considerable and continuous R&D investment are needed to promote innovation wireless communications and broadcasting areas. In Korea, spectrum charges are imposed on the steps of the assignment of a radio frequency and the radio stations established. The former recover the economic value of the radio waves and the latter impose administrative costs of the spectrum fee. The former is divided into two assignments of a radio frequency under the 11th article and 12th article, Radio Waves Act. Both assignments of a radio frequency must be made to the same legal rules. And, In accordance with the 1st clause, the 67th article, Radio Waves Act, the Korea Communications Commission can impose and collect spectrum fee on using radio stations for appropriating the spectrum management costs and for promoting the fields involving radio spectrum. Spectrum fee must be imposed and collected under user pays principle. I ultimately expect the scope of using spectrum fee to be enacted more clearly and precisely.
