Abstract
In 2008, virtual currencies emerged in the world, beginning with Bitcoin, and they were used as a means of fraud, money laundering, drug trading and caused great social problems. Therefore, the US has issued guidelines on the most problematic areas related to money laundering since 2013 and has issued investor warnings by SEC and CFTC. However, there are still no unified federal laws that every state has adopted, and each federal agency regulates virtual currencies according to relevant laws. In the state law, there are states that set up new regulations like New York State, but like Washington State, they also regulate virtual currencies by the existing Uniform Money Transfer Act. As a result, dual regulation of the federal agency level and state law level is being implemented. The implication of US virtual currencies regulations is that the virtual currencies are regulated by the system within a short period of time to enhance user protection and encourage industry. For example, the SEC basically does not regulate ICO but applies related laws as investment contracts under existing securities laws only for some ICO types in question. In addition, efforts to enact new regulations such as New York State or to regulate virtual currencies into the existing Uniform Money Transfer Act such as Washington State could have a significant impact on Korea ‘s financial authorities, which hesitate to regulate virtual currency. Although New York State’s BitLicense is limited to the New York state law, not the United States federal law, it focuses on protecting users and preventing illegal money laundering by fully reflecting the characteristics of virtual currencies. The most distinctive feature of this law is that it imposes a great deal of responsibility on those who run virtual currencies business activities company to compensate for the risks of virtual currencies. New York State BitLicense has regulations similar to those of banks, money transfer providers, and securities companies. Specifically, the minimum capital requirements (banks and securities companies), customer information collection obligations (banks), customer risk disclosure (Securities firms). The implication of US New York State BitLicense to Korea is that it creates a certain entry regulation for virtual currencies business activities company. And it is able to conduct virtual currencies business activities only for those who have been granted permission. However, BitLicense does not contain the manipulation regulations. When introducing the legal provisions related to virtual currencies in Korea in the future, Government of South Korea should also introduce regulations on manipulation.
