Abstract
With the spread of the Internet, starting with communication using nicknames or non-real name IDs, expression by anonymity without specifying an identity has become common. And it is common to understand that such anonymity is also a form of expression and is guaranteed by the freedom of press and publication prescribed in Article 21, Paragraph 1 of the Constitution of the Republic of Korea. However, today, amid the widespread and behavioral monitoring of information collection and handling using information and communication technologies by public authority, etc., the anonymity of expressive objects expressed without revealing the identity can be simply deprived. In addition, situations in which the freedom of anonymous expression may be limited in reality, such as the spread of social media based on real name subscription and the real name system implemented in some countries such as China, are expanding. If so, it is questioned how much freedom of anonymous expression should be guaranteed under the constitution. In the case of the United States, there is a lot of discussion about the guarantee of the freedom of anonymous expression based on the provisions of the First Amendment. In this regard, this paper will review the theories and precedents related to anonymous expression in the United States, and examine the need to protect the freedom of anonymous expression in the Korean Constitution.
