세계와 한국의 복권정책에 관한 연구

초록

세계 복권산업에 발맞추어 한국 복권시장의 규모는 21세기부터 비약적으로 발전하고 있다. 본 연구는 이러한 복권산업에서 규제유형과 정책유형에 따라 정부정책이 어떻게 달라지는지 세계와 한국의 정책사례를 분석하였다. 연구의 배경으로는 Kingma(2008)의 도박규제모형, Lowi(1964; 1972)의 정책유형, Rhodes(1996)의 거버넌스 이론을 채택하였다. 분석대상은 복권을 금지하는 이슬람국가 3국, 국내복권허용국가 3개, 국제복권허용국가 3국, 총 9개 국가로 하였다. 사례분석결과 세계의 복권은 금지모형, 공익모형, 위험모형 세 유형에 따라 정책유형과 정책내용이 달라진 것을 확인하였다. 첫째 복권을 금지하는 이슬람계 국가에서 나타난 것으로 복권을 죄악적 행위로 규정하고 코란의 율법에 따라 다스리며 규제 위주의 정책이 적용된다. 둘째 복권을 공익적 목적으로 운영하는 국가는 국내복권만 합법으로 정의하고, 그 수익금은 정부 주도적으로 사용하며, 정책은 복권수익금의 배분에 집중된 내용이 주를 이루었다. 마지막으로 국제복권을 인정하는 국가는 복권산업을 IT의 확산과 시장의 국제화 측면에서 위험산업으로 정의하고, 기술표준과 사회규범 입장에서 거버넌스 차원의 정책을 적용한다. 세계 사례를 한국 복권에 적용한 결과, 한국 복권은 기술기반의 위험모형으로 발전했음에도 불구하고 정책은 여전히 도박으로 인식하여 규제중심으로 집행되고 있다. 그러나 한국은 정보기술의 도입으로 인해 복권이 국제적인 문화 산업으로 발전되어 가고 있을 뿐 아니라 인터넷 중심의 불법도박이 커져 통제 불가능한 상태이다. 국내 경제와 정부재원에 위험과 기회를 동시에 가져올 뿐만 아니라 전체 사행산업으로 확산된 현시점에 정책관점에서 규제를 넘어서 문화적이고 기술적인 대응정책이 필요하다는 점을 주장하는 바이다.

Abstract

This study had conducted the case analysis of regulation about lottery policy in Korea and World. The research analysis is based on the gambling industry regulation model (Kingma, 2008), policy type(Lowi, 1964; 1972) and governance theory(Rhodes, 1996). There are three regulation model with Prohibit Model, Alibi Model and Risk Model. Research scopes of case study are 9 countries for three different regulation model. The result of case analysis is as followed: as identified by the theoretical contemplation, the lottery policies have been changed by regulation model and policy type about lottery. Prohibit Model deals with a social problem, such as gambling that proliferated before the establishment of governments in islam countries. Alibi Model refers justified policy for the lottery issued for the public welfare countries like USA, Japan, Korea. Risk Model refers to the economic phenomenon after the spread of recent internet technology throughout not only the lottery industry, but also all areas of society and the international game market like UK, Norway and Swissland. As a result of global lottery status analysis based on the review of preceding documents, it was confirmed that the global lottery market has transformed as described by the Risk Model. Under such international environment, the regulation such as annual sales cap contemplated in Korea is believed to be ineffective. The game market is growing day by day and the types of game are also multiplying. The lottery is also becoming an area of entertainment globally, and the global players can freely purchase lotteries of other jurisdictions through the internet. Globalization is no longer an option, but a matter of survival also in the lottery industry. Korea must join the governance of international gaming industry in a variety of perspectives, such as policy, system, culture and so on.
