Abstract
The characteristics of digital content and digital services, which is distinct from traditional things or goods, have inevitably led to a situation where it is not sufficient to be regulated by the existing legal order, and such legal disparity has been an obstacle to both the development of digital content and digital services, and a smooth trading order. The European Union, in response to this, has made legislative efforts and has reached a Directive (EU) that can provide uniform regulation within EU member countries, containing a somewhat balanced content on several important matters related to digital content and digital services. The result of that effort is the DIRECTIVE (EU) 2019/770 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 20 May 2019 on certain aspects concerning contracts for the supply of digital content and digital services(‘Directive (EU) 2019/770’). This article has reviewed the Directive (EU) 2019/770 with a focus on the obligations of the trader and the consumer in the event of termination of the contracts for the supply of digital content and digital services, because the obligations of the trader and the consumer in the event of termination of the contracts for the supply of digital content and digital services, can well illustrate the characteristics of digital content and digital services, and related transactions. Article 16 of the Directive (EU) 2019/770 stipulates the trader’s obligation to reimburse sums paid under the contract, obligations in respect of personal data, obligation in respect of content other than personal data, and obligation to make content other than personal data available, and the trader’s right to prevent further use of digital content or digital service, in the even of termination. Article 17 of the Directive (EU) 2019/770 stipulates the consumer’s obligation to refrain from using digital content or digital service, refrain from making digital content or digital service to third party, and the obligation to return the tangible medium on which content supplied, and the limitation of obligation to pay for use of digital content or digital service, in the even of termination. The amendment to Article 733-6 of the Korean Civil Code only briefly stipulates the relationship between the provider and the user, and does not regulate the return relationship of digital products at all. There are concerns whether the content of the ongoing amendment alone can guarantee predictable and sufficient rights and obligations for both the provider and the user. In the process of drafting the amendment to the Korean Civil Code, the contents of the Directive (EU) 2019/770 have been an important reference, and it is expected to continue to serve as meaningful material in future amendment discussions.
