Abstract

This study aims to contemplate on the characteristics of the 2005 UNESCO Convention on Cultural Diversity and research how the Convention actually has been implemented for the ten years since. For this purpose, this paper will look at the cultural mission of UNESCO to consider that the 2005 Convention is an assertive protection method contrary to the previous cultural protection on the passive level. However, this assertiveness requires interpretation and it is ambiguous how to resolve when the 2005 Convention and another International Norm conflict. China — Publications and Audiovisual Products case of 2009 demonstrates that the Convention did not have a substantial impact under the WTO regime, but it did show that with regards to cultural goods, the WTO agreements can be subject to flexible interpretation. On the other hand, with the case of the European Union, Unión de Televisiones Comerciales Asociadas v.. Spain case at the European Court of Justice in 2009 showed that the Convention on Cultural Diversity Convention does serve as an assertive protection device for effectively promoting culture. However, in a similar case of Fachverband der Buch-und Medienwirtschaft v. LIBRO, the European Court of Justice ruled conflictingly, indicating that an active application of the Convention has limitations. Moreover, the media policy of the EU represented by the Television without Frontiers Directive(1989) and Audiovisual Media Service Directive(2007) leave little room for the implementation of the Convention. They show that the Convention still serves only as a basis for supporting a protective role of Cultural Quota that safeguards the cultural industry. As long as the European Union protects its cultural diversity in an exclusionary eurocentric way, the competitive European culture is far off the way. Considering that the EU was one of the most active partners of UNESCO in the adoption of the Convention on Cultural Diversity, its progress for the past ten years is somewhat disappointing.
