Abstract

The concepts of “family unity” and “family reunification (or “family reunion”)” both stem from the universal recognition of the family as a fundamental unit, and they share the common feature of manifesting in the form of “living together”. However, these terms are not synonymous, and one cannot be definitively subsumed under the other. This distinction is clearly articulated in the Convention on the Rights of the Child, which separately affirms the guarantees of both family unity and family reunification. Despite their differences, the terms “family unity” and “family reunification” are often used interchangeably, without a clear distinction. This is particularly evident when the legal foundation for the right to family unity is mistakenly cited as the basis for claims of family reunification. Such an approach may undermine the strength of the argument, as it fails to properly address the conceptual distinctions between these terms. Thus, this article aims to examine the definitions and descriptions of family unity and family reunification as articulated in various international treaties and human rights frameworks. It seeks to clarify the distinct features of family reunification that set it apart from family unity by analyzing these legal instruments. By emphasizing the normative distinctions between these concepts, this paper contributes to a deeper understanding that may inform future legal research and the development of policies in this area.
