Abstract
The Fifth Amendment of the United States Constitution provides that private property may not be taken for a public use without payment of just compensation. It is very difficult to identify the differences between the taking which causes the compensation and the regulation of the properties which does not accompany with the principle of just compensation. Most of the legal theories of taking have been embodied by the cases of the Federal Supreme Court, and those are often unclear and inconsistent. Courts and scholars have paid significantly less attention to questions about just compensation than the public use factors. It is significant to pay heed to the argument that inadequate compensation of property owners is greatly ton blame for unjust and inefficient takings. Reforming just compensation would have a more positive and balanced impact on property owners and the public than would restricting public use. It is more desirable to shift the focus of the takings debate not to the public use debate, but to just compensation. When the government takes property, how should just compensation be assessed? It is settled law that compensation for takings is measured by the fair market value of the property taken, but this standard includes a number of important decisions. These involve selecting whether to value the property by the owner’s loss or government’ gain, allocating development risk between the government and the property owner. In the article, Part Ⅰ raises the need to preview the subject and Part Ⅱ deals with the difference debates between regulatory takings accompanying with just compensation and the regulation of the properties which does not accompany with the principle of just compensation, which are discussed in the Supreme Court Cases. In Part Ⅲ, I examine the standard of appreciating just compensation in the case of eminent domain and the standard date of assessing compensation expenditure. In Part Ⅳ, I parse and evaluate the standard of appreciating just compensation in the Supreme Court Cases and consider reforming debate. Finally, I emphasize that the standard for what constitutes and is include in just compensation has to be fairer and more efficient in Part Ⅴ.
