드워킨의 운평등주의에 대한 비판적 고찰

운평등주의(luck egalitarianism)는 롤스 정의론의 아이디어를 기반으로 한 평등주의 이론이다. 법철학자 로널드 드워킨(Ronald Dworkin)이 대표적인 운평등주의 사상가 로 알려져 있다. 드워킨은 자원평등론에서 각각의 사람들이 삶에서 이용할 수 있는 자원의 분배적 평등을 실현하기 위해 선택과 운을 구별한다. 그는 정치공동체의 구 성원의 인성(personality)이 반영된 선택운(option luck)의 결과는 개인이 책임져야 하 지만, 여건(circumstances)으로 인한 비선택운(brute luck)의 불평등은 부당하며 보상을 요구할 수 있다고 주장한다. 이러한 드워킨의 구별은 선택 책임과 불운 보상을 핵심 으로 하는 운평등주의 이론의 핵심 주장으로 인용되고 있다. 그러나 드워킨의 선택운과 비선택운 구별은 한계를 가지고 있다. 먼저 선택운과 관련하여 드워킨은 개인의 소망, 취향과 같은 인성이 반영된 선택은 개인이 전적으 로 책임을 져야 한다고 주장한다. 하지만 모든 선택운을 개인의 책임으로 돌릴 수 없 으며, 인성이 형성되는 과정이나 선택 결과에 개인이 통제할 수 없는 행운이나 불운 이 개입되는 경우를 고려할 필요가 있다. 또한 비선택적 불운에 대한 금전적 보상은 시혜적 보상과 낙인찍기의 문제와 같은 자본주의 복지국가의 한계와 관료주의의 폐 해를 발생시킨다. 결론적으로 드워킨의 운평등주의 이론은 선택 책임이라는 자유주의적 가치와 불 운 보상이라는 평등주의적 가치를 통합하는 이론적 의의가 있지만, 현실의 평등 요 구에 적절히 부응하지 못한다는 한계를 가지고 있다.
Abstract
Luck Egalitarianism is an egalitarian theory based on the idea of Rawls’s A Theory of Justice. Legal philosopher Ronald Dworkin is known as a representative luck egalitarian thinker. Dworkin distinguishes between choice and luck in order to realize the distributive equality of the resources available to each person in life. He argues that although the individual is responsible for the outcome of the option luck that reflects the personality of members of the political community, the inequality from brute luck caused by the circumstance can be unjust and require compensation. This distinction is cited as a core argument of the luck egalitarianism theory centered around choice-responsibility and unluck-compensation. However, the distinction between Dworkin’s option luck and brute luck has some limitations. First of all, with regard to option luck, Dworkin argues that choices that reflect personality such as an individual’s ambition and taste, should be entirely up to the individual responsibility. However, all of the result of option luck is not the responsibility of the individual, considering the process of individual personality formation or the result of the choice may involve good or bad luck that cannot be controlled by the individual. In addition, with regard to the compensation for brute luck, the monetary compensation for bad luck causes the limitations of the capitalist welfare state and the abuses of bureaucracy such as the problem of dispensation of compensation and stigmatization. In conclusion, Dworkin’s theory of luck egalitarianism has theoretical significance in integrating the liberal value of option-responsibility and the egalitarian value of unluck-compensation, but it has the limitation that it fails to properly meet the demands for equality in reality.
