SPS 협정 제6조 관련 쟁점분석 및 국내 법제 검토

SPS 지역화 규정인 제6조가 도입되었지만 그 이행과 관련하여 여러 어려움이 노정되었고 India-Agricultural Products 사건과 US-Animals 사건, Russia-Pigs 사건에서 WTO 분쟁해결절차를 통해 SPS 지역화와 관련한 규정의 해석과 적용을 검토되었다. 본 논문에서는 SPS 지역화와 관련하여 WTO SPS 협정 제6조의 해석과 적용에 대한 최근 WTO 분쟁사건들을 살펴보고 제6조에 대한 검토순서 및 제6.2조에 대한 Russia-Pig 사건 상소기구의 판시에 대한 평가를 담았다. 또한 우리나라의 SPS 지역화와 관련하여 국내 법제 및 관련 이행에 대해 분야별로 검토하였다.
Abstract
Article 6 of the WTO SPS Agreement provides explicit provisions on SPS regionalization, but it is difficult to implement due to divergences in interpretation and implementation of international guidelines, the lengthy process in importing countries for recognizing pest- or disease-free areas or areas of low pest or disease prevalence, and complexities involved in risk assessment. Against this backdrop, the cases of India-Agricultural Products, U.S.- Animals, and Russia-Pigs (EU) offered further clarification of the principle of regionalization in the context of WTO law. These precedents of decisions reached at the WTO Panel and Appellate Body have had the effect of strengthening the burden placed on importing countries. In this paper, I examine the WTO disputes concerning SPS regionalization focused on article 6 of the WTO SPS Agreement and review domestic legislations on SPS regionalization by sector to ensure the compliance with the obligations within WTO agreements.
