이혼시 재산분할청구권에 관한 한․중 비교연구

Abstract

This paper is a comparative study on the mechanism of property division upon divorced in Korean and Chinese family law. The Chinese marriage law revised in 2001 also provides the right of claim of property division called 'Property compensation right'. The property division and property compensation right in Chinese marriage law and Korean civil law are much alike in an aspect. According to this similarity, this paper will be discussed the characteristic of the revised Chinese marriage law and introduce the picture of the changing Chinese matrimonial property law with the tendency of world through the comparative study.
