글로벌 경제시대에 걸맞게 국가간의 무역은 점차로 활성화되고 다국적 제조 및 유통은 증대되고 있는 추세에 있는 것으로 파악된다. 이러한 현황과 관련하여 제조물책임에 대한 국제사법상의 문제는 더한층 복잡한 논의구조를 거치게 되는데, 특히 각국의 법원에서는 자국의 소비자 보호와 사회적 이익 간 균형을 달성하기 위하여 과연 어떤 법을 적용할 것인지 더욱 고민할 수밖에 없는 상황으로 이해된다. 이 글은 그러한 문제 및 상황에 대한 인식에 기반하여, 제조물책임에 관한 국제사법상 일반 원칙의 설정에 관하여 법 적용 기준의 관점에서 논의하고 있는바, Kasel v. Remington Arms Co. 사건, Decker v. Fox River Tractor Co. 사건 등을 면밀히 분석·검토하고 이후 법 적용의 기준에 관하여 단계적, 순차적 접근 방법을 구체적 적용례와 함께 제시하고 있다.
