민간경비산업의 발전은 공공서비스의 민간참여와 ‘수익자 부담이론’에서 비롯된 정책적 선택의 결과라고 할 수 있다. 그러나 민간경비산업은 치안서비스에서의 공공재 대리역할이라는 사회적 기대에도 불구하고 양적증가에만 국한되어 질적 제고를 위한 실질적 논의가 전혀 이루어지지 못하고 있다. 특히 규제와 관련하여서는 초보적인 연구단계라 할 수 있다. 본 연구에서는 민간경비 규제와 관련하여 지대추구와 과점형태, 규제개혁에 대하여 정리해 보았다. 우선 지대추구와 관련하여 직업면허제도와 지정위탁교육기관의 문제점을 살펴보고 두 번째로 규제완화나 새로운 규제의 발생이 기득권 보호를 위한 목적으로 사용되는 과점형태의 시장과 규제기관 포획현상을 찾아보았다. 마지막으로 관리․감독기관인 경찰의 효율적 활동을 위하여 사전적 규제가 아닌 사후 규제로의 전환과 경비업체 허가기준의 현실화를 위한 규제품질의 강화에 대하여 논의하였다. 본 연구에서는 민간경비 산업과 관련된 규제의 유형과 이에 따른 현상들을 정리하여 보고 민간경비 관련 규제 정비의 올바른 방향을 제시할 수 있는 정당성을 찾아 설명하고, 향후 어떠한 방법과 기준으로 규제정비를 진행시켜야 할지에 대하여 제시하였다.
Abstract
Attribute to the result of choosing a policy, the improvement of a private security industry comes from a participation of the private sector to the public service and the profit oriented enterprise theory. Despite social expectation to the private security industry as a subrogation role for public goods in the public security service area, a practical discussion to promote quality never been discussed only it was limited to quantity expansion. Especially, related to the regulation, it is in the early research stage. Related to the private security industry regulation, in this study, the rent seeking, oligopoly form and regulatory reform will be discussed. Under the issue of rent seeking, the occupational licensing institution and problem of the designated consignment educational agency will be discussed. Second, deregulation and occurrence of new regulation for the purpose of utilization at the market of oligopoly form and the regulatory capture phenomenon will be discussed. Finally, effective action for the police which is an administration and a supervision agency requires switch to a post-regulation other than to a pre-regulation for the regulation reform as well as need to discuss standard of permission in the reality basis to consolidate quality of regulation at the security guard enterprise. The expected outcomes of this study as follows: First, type of regulation which is related to the private security industry and it's following phenomenon will be organized. Second, finding justice which is lead to upright direction for the related private security industry will be explained. Finally, further method and standard for regulation maintenance will be suggested.
