경찰의 IDS 운영 실태와 위치추적권에 대한 고찰

경찰관은 범죄가 발생했을 때 적극적인 자세와 사명감을 가지고 신속하게 대응하고,급박한 상황이 목전에 있을 때에도 스스로 판단하여 합리적인 결정을 내려야 한다. 그러나 범죄를 진압하는 과정에 적용되는 불필요한 법률규정과 통제는 업무에 집중하는데 상당한 지장을 초래할 수가 있다. 경찰청 자료에 의하면, 2010년 한 해에 접수된 112신고 현황은 총 8,564,736건으로 나타났고, 이 중에서 중요범죄는 228,228건이 접수되었다. 이렇게 끊임없이 발생하는 강력범죄와 112신고에 대응하는 경찰은 범죄피해자의 급박한 상황에 초점을 맞추어야만 한다. 112신고가 접수된 강력사건은 신속하게 범죄피해자를 구조해야 하고, 범죄현장에 도착하기 위해서는 경찰의 자동위치추적권이 반드시 필요하다. 강력범죄로부터 국민의 생명과 신체 그리고 재산을 보호하기 위하여 경찰의 자동위치 추적권을 위해서는 첫째, 112상황실에 접수된 범죄피해자 위치파악에 필요한 경찰의 자동위치추적권이 발동될 수 있도록 위치정보의 보호 및 이용 등에 관한 법률 규정이 개정되어야만 한다. 둘째, 강력사건이 발생한 범죄현장의 급박한 상황을 적극 고려하여 세심하고 숙련된 112센터요원들을 양성ㆍ배치하고, 112상황대처 매뉴얼을 개발하여 교육ㆍ훈련해야만 한다. 셋째, 경찰의 112순찰차량 신속배치시스템(IDS)과 관련된 최첨단장비를 전국에 일률적으로 확충하여야 한다. 넷째, 112신고를 접수하고 현장에 출동하여 경찰관직무집행법 상 위험지역 출입과 탐문수사를 위해 치안공공재를 지역주민과공동으로 창출해야만 한다.
Abstract
Police officers should respond to crime with positive attitude and mission when a crime occurs. Also, They make rational decisions by their own judgment when emergency situation occurs. However, the control of unnecessary laws and regulations of the business could not a focused on their mission.48)According to statistics released by the National Police Agency(NPA), in 2010 a total of the 112 dispatch were the case of 8,564,736. Violent crime incidents were received 228,228 cases. The 112 dispatch must focus on the victims of crime when violent crime occurs and rapidly rescue victims of crime. Police’s automatically location system powers is necessary in order to arrive at crime scene. Police’s automatically location system powers in order to protect the citizens life,body, property from violent crimes as follows:First, Police’s automatically location system powers for the 112 dispatch is received by victims of crime. In this regard, 「Act on the Protection and Use of Location Information」 provision should revised. Second, Police agency must allocate highly skilled 112 agents in the urgent situation and develop 112 dispatch manuals. Third, Police IDS of state-of-the-art equipment shall be expanded across the country. Fourth, Police have to investigate legwork related 「Act on the Performance of Duties by Police Officers」 and create public goods with the citizens.
