규제를 통한 공공미술 지원 제도의 문제와 과제: 한국의 건축물 미술작품 제도 사례 분석

한국의 『문화예술진흥법』은 “대통령령으로 정하는 종류 또는 규모 이상의 건축물을 건축하려는 자는 건축 비용의 일정 비율에 해당하는 금액을 회화·조각·공예 등 미술작품의 설치에 사용하여야 한다.”고 규정하고 있다. 이 규정에 따른 제도가 한국의 ‘퍼센트 미술(percent for art) 제도’인 ‘건축물 미술작품 제도’이다. 이 제도는 건축주가 미술작품을 구매하게 하고, 구매한 미술작품을 공개된 장소에 설치하도록 한다. 이 제도는 공공미술 활성화에 기여할 것이라는 기대를 받고 있다. 그런데 이 제도는 여러 정책 도구 중 규제를 선택하고 있다. 그 결과, 지금까지 1만 5천여 개의 미술작품들이 설치되는 놀라운 성과를 만들어냈다. 그런데 시민들은 건축물 미술작품들이 자신들의 문화향수에 기여하지 못하고 있다고 인식한다. 본 연구는 그 원인을 건축주에게 설치를 강요하고 있기 때문이라고 주장한다. 정부는 다양한 제도 보완을 시도하고 있지만, 본 연구는 두 가지 이유 때문에 제도에 대한 근본적인 검토가 필요하다고 주장한다. 첫째, 민간 건축주에게 부담 책임이 있다고 말할 수 없다. 둘째, 공개된 장소에의 설치가 공공미술의 충분조건이라고 말할 수 없다. 따라서 본 연구는 건축물 미술작품 제도는 대상 범위를 점진적으로 축소하여 공공 건축물로 대상의 범위를 최소화하고, 이와 동시에 건축물 미술작품 제도를 대신할 수 있는 새로운 공공미술 지원 제도가 고안되어야 할 것이라고 주장한다.
Abstract
In South Korea “Culture and Arts Promotion Act” says that “Any person who intends to construct any building in the category or not less than the size prescribed by Presidential Decree shall spend an amount at a specified ratio of the construction cost of the building on the installation of artworks, such as pictures, sculptures, crafts, etc.” Artworks for Buildings Policy is codified as this Act in South Korea in line with “Percent for Art”. Following this policy, the building owner, even private one, should purchase the artworks and install them in the public place no matter what his or her preference. This is indeed the regulation policy. Accordingly, this policy shows remarkable results in that 15,000 pieces of artworks have been installed in South Korea until now. This policy is expected to contribute to the promotion of the public art in this regard. Contradictorily, people perceive that this policy rarely contributes to their enjoyment of art. We assert that it occurs because this policy compels the building owners to purchase and install the artworks. The government have tried several institutional complement, but to no avail. We here suggest two critical factors necessary for fundamental review. First, the private building owners are not liable for paying costs. Second, the installation of the artworks in the public place is not a sufficient condition for the public art. We thus suggest that the target scope of this policy be curtailed gradually and then minimized up to only public buildings. Along with this, we claim that a new public art support policy should be designed in place of Artworks for Buildings Policy.
