북한 이탈 청소년의 법의식 연구 : 제3국 체류경험의 영향을 중심으로

이 연구는 북한이탈 청소년 법교육을 위한 기초연구의 일환으로, 탈북과정의 경험이 법의식 형성에 미치는 영향을 분석하였다. 통계적 분석을 위하여 탈북과정의 경험을 개인요인, 가족요인, 또래관련요인, 지역사회요인으로 구분하였으며, 법의식은 인지적 요소, 정서적 요소, 행동적 요소로 구분하였다. 분석 결과, 북한이탈 청소년의 법의식은 제3국에서 겪는 경험이 유의미한 영향을 주는 것을 확인할 수 있었다. 특히 북한이탈 청소년 자신의 일탈행위 경험, 탈북 과정의 가족 해체 여부, 일탈 행위 시 훈육과 지도를 받은 경험, 북한이탈 청소년에 대한 지역사회 구성원의 태도 등이 법의식 형성에 영향을 주는 중요한 요인으로 분석되었다. 따라서 북한이탈 청소년에 대한 법교육은 이런 경험을 고려하여 학습 내용과 방법을 구성하여야 효과를 가질 것이다.
Abstract
This article is a part of the basic research for the law-related education for the North Korean adolescent refugees. We analyzed the effect of the experiences in the course of escaping from the North Korea on the formation of the legal consciousness. We have classified the relevant factors of the experiences into personal factors, family factors, peer group factors, community factors for statistical analysis. And the elements of legal consciousness was classified into cognitive, emotional, and behavioral element. As a result, the experiences in the third country influence on legal consciousness of North Korean adolescent refugees significantly. Particularly, it is analyzed that the breakaway experience of North Korean adolescent refugees, the family disorganization during the process of breakaway and the attitude of community towards North Korean adolescent refugees influence on the formation of the legal consciousness. Therefore the law-related education for the North Korean adolescent refugees has to construct learning contents and teaching methods considering these experiences.
