북한이탈주민의 법의식이 범죄행동에 미치는 영향: 법의식의 세부 영역을 중심으로

이 연구는 북한이탈주민의 법의식에 초점을 두고 법의식을 구성하는 세부요소가 범죄행동에 유의미한 영향을 미치는지 검증하여 궁극적으로 북한이탈주민에 대한 법의식 교육이 나아가야 할 방향을 모색하고자 한다. 분석은2017년 형사정책연구원(현 한국법무정책연구원)의 ｢북한이탈주민의 법의식실태와 준법의식 제고 방안 연구｣에서 진행한 연구자료를 한국사회과학자료원으로부터 제공받아 진행하였다. 본 분석은 SPSS 29.0을 활용하여 기술통계 분석, 상관관계 분석, 그리고 이항 로지스틱 회귀분석을 실시하였다. 분석결과 법의식 세부 구성요소 중 특히 법 친밀감이 95% 수준에서 법에대한 친밀감이 클수록 범죄행동을 할 가능성은 36.4% 정도 감소하는 것으로 나타났다. 분석결과를 바탕으로 한 정책적 제언은 다음과 같다. 첫째, 법교육 프로그램 내용의 개선과 둘째, 법의식 교육 방향성의 재정립 및 보완이다. 이러한 정책적 제언은 공통적으로 교육 중 형사사법시스템등에 대한 경험이 단순한 법지식의 함양이 아닌 법에 대한 정서를 확립한다는 점을 바탕으로 한다. 연구의 내용을 바탕으로 할 때 이 연구는 북한이탈주민을 대상으로 한다는 점, 법의식의 세부 영역별로 범죄행동에 대한 유의미한 영향이 있는지를 분석함으로써 북한이탈주민에 대한 법의식 교육의궁극적 지향점을 제시한다는 점에 그 의의가 있다
Abstract
This study aimed to verify whether the detailed elements of legal consciousness of North Korean Refugees have a significant effect on criminal behavior. The analysis was conducted using research data provided by the Korea Social Science Data Institute in the 2017 “Research on the Current Status of Legal Consciousness and Measures to Improve Law-abiding Consciousness of North Korean Refugees.” This analysis was conducted using SPSS 29.0 to perform descriptive statistical analysis, correlation analysis, and binomial logistic regression analysis. The analysis results showed that among the detailed elements of legal consciousness, in particular, the greater the familiarity with the law at the 95% level, the lower the likelihood of committing a crime by approximately 36.4%. The policy recommendations based on the analysis results are as follows. First, improvement of the contents of the legal education program, and second, re-establishment and supplementation of the direction of legal Consciousness education. Based on the content of the study, the significance of this study lies in the fact that it targets North Korean Refugees and analyzes whether each detailed area of legal consciousness has a significant effect on criminal behavior.
