사법작용에 관한 시민성 분석 - 중학교 「사회」와 고등학교 「정치와 법」 교과서에 대한 내용분석을 중심으로 -

다른 국가권력 작용과의 관계에서 요구되는 시민성에 비해, 사법작용과의 관계에서 요구되는 시민성은 그동안 명시적으로 논의되지 못했다. 이에 본 연구는 사법작용에 관한 시민성이 무엇인지, 사법작용에 관한 시민성 교육은 어떻게 이루어지고 있으며, 어떻게 이루어지는 것이 바람직한지를 탐색하였다. 헌법을 분석한 결과, 사법작용의 주체의 위치에서는 국민주권의 원리를 바탕으로 사법작용에 관심을 가지고 이를 감시･비판하고, 이에 대해 의견을 개진하며 참여하는 시민성이 요구된다. 객체의 위치에서는 사법작용과의 관계에서 보장되는 권리를 알고 이를 적극적으로 추구하고 행사하는 시민성이 요구된다. 한편, 오늘날의 사법제도는 국민참여재판제도 등을 바탕으로 사법작용의 주체로서의 시민성을 강조하고 있을 뿐만 아니라, 사법의 수요자로서 능동적으로 이를 활용하는 시민성을 요구하고 있었다. 그러나 시민성 교육을 행하는 중학교 「사회」와 고등학교 「정치와 법」 교과서를 분석한 결과, 시의적절성 측면에서 오늘날 강조하고 있는 주체로서의 시민성 내용을 충분하게 다루고 있지 못했다. 사법작용 역시 참여의 대상이 된다는 점을 충분히 인지하지 못한 채 교과서 서술이 이루어지다 보니, 정치 과정에 대한 설명을 하는 데 있어서 사법작용을 배제하고 서술하는 등 정확성 측면에서 어긋난 서술도 있었다. 그리고 사법작용에 관한 주체로서의 시민성과 객체로서의 시민성을 양성하는 데에 효과적이지 못한 구성을 취하고 있었다. 이에 기존에 간과되었던 사법작용에 관한 시민성 내용을 염두에 두고, 이를 강조하는 교과서 서술 및 이를 바탕으로 한 시민성 교육이 이루어져야 할 것이다.
Abstract
Compared to the citizenship required in relation to other state power functions, the content of citizenship required in relation to the judicial action has not been explicitly discussed so far. Therefore, this study explores what citizenship is in relation to judicial action, how citizenship education about judicial action is conducted, and how it is desirable to do so. As a result of analyzing the constitution, the position of the subject of judicial action requires citizenship to have interest in judicial action based on the principle of national sovereignty, monitor and criticize it, express opinions and participate in it. In the position of an object, citizenship is required to know the rights guaranteed in relation to judicial action, and to actively pursue and exercise them. On the other hand, today's judicial system not only emphasizes citizenship as a subject of judicial action based on the public participatory trial system, but also requires citizenship to actively utilize it as a demander of judicial justice. However, as a result of analyzing the textbooks of middle school 「Social Studies」 and high school 「Politics & Law」 that provide citizenship education, the content of citizenship as a subject emphasized today in terms of timeliness was not sufficiently covered. As textbook descriptions were made without sufficiently recognizing that judicial action is also an object of participation, there were some inconsistent descriptions in terms of accuracy, such as overlooking judicial action in explaining the political process. And it was not effective in fostering citizenship as a subject and citizenship as an object of judicial action. Therefore, it is necessary to take into account the contents of citizenship regarding the judicial action that were previously overlooked, emphasize them in school textbooks, and provide citizenship education based on them.
