본 연구에서는 소송감정 사례의 진행 과정을 중심으로 소송 진행 과정, 판결의 이유에 대한 의견, 절차진행에 대한 의견을 제시함으로써 소송감정평가액의 신뢰성을 확보하고 재감정에 따른 사회적 손실을 최소화시킬 수 있는 방안을 모색하였다. 판례의 분석 결과, 감정평가 업무의 신뢰성과 객관성 확보를 위해서는 첫째, 감정인의 감정에 대한 제3기관의 평가 필요성이 대두된다. 둘째, 법원은 전문재판부 제도나 전문가(경력이 있는 감정평가사)를 확보하기 위한 노력을 통해 판결의 신뢰성을 제고할 수 있다. 마지막으로 이해관계가가 납득할 수 있도록 감정평가에 관한 구체적 논거가 충분히 제시될 필요가 있다.
Abstract
This study explores the process of proceeding with case reviews, opinions on the reasons for the ruling, and opinions on the process to seek the reliability. As a result of the analysis of the case law, it is necessary to evaluate the emotional performance of the expert in order to secure the reliability and objectivity of the emotional assessment task. Second, a court may enhance the reliability of a ruling in its efforts to secure a professional justice system or professional (appraisals with experience). Finally, a detailed rationale for the appraisal of the emotions needs to be provided in order to ensure that the design of the assessment is understood.
