국민의 권리의식이 강화되고 삶의 질에 대한 관심이 증가한 상황에서 선하지에 관한 손실보상제도는 미흡하여 많은 갈등이 있다. 본 연구는 선하지에 관한 손실보상제도의 쟁점을 분석하고 합리적인 개선방안을 도출하는 것이 목적이다. 본 연구의 결과는 선하지의 손실보상제도를 개선하는데 기여할 것이다. 연구결과 손실보상제도의 쟁점으로 선하지의 범위, 「선하지 평가지침」의 내용, 잔여지의 보상문제, 기설 선하지의 보상, 배전선로의 보상여부, 권원확보방법, 최저보상액의 설정 등 7가지를 도출하였다. 개선방안으로 선하지의 범위 조정, 「선하지 평가지침」의 개정, 잔여지 감가의 별도 보상, 기설 선하지의 신속한 보상, 배전선로의 보상 실시, 지역권 설정의 검토, 최저보상액의 상향을 제안하였다.
Abstract
The knowledge of people's rights has been enlarged., but the compensation system on the land under power lines is insufficient. Thus there has been a lot of conflicts on the compensation on the land under power lines. The purpose of this study is to analyse the issues about the compensation system and to improve the system. Thus this study will contribute to improve the compensation system of the land under power lines. The followings are the seven issues on the compensation system..: The range of the land under power lines, the content on appraisal regulation, compensation problems on residuary land, the compensation problems on the land under existing power lines , the compensation problem on distribution lines, the ways of registering the title, determination on minimum amount of compensation. The improvement of the issues are the followings: The adjustment on the range of the land under power lines, revision of appraisal regulation, extra compensation on residuary land, prompt compensation on the land under existing power lines, compensation on distribution lines, consideration on registering essement, raising the minimum amount of compensation.
