현재 우리나라에서 시행되고 있는 필지정리와 관련된 법들은 대체로 사업지구지정방식을 전제로 하였기 때문에 좁은 면적의 소규모필지에 적용하기에는 한계가 있다. 본 연구에서 저자들은 소규모 토지분할의 문제점에 착안하여 경계조정이라고 하는 보다 간편한 방식을 통해 국민들의 불합리한 토지경계를 조정하기 위한 방안을 제안하였다. 이를 위해서 저자들은 소면적 토지분할과 관련한 현행법들의 문제점을 고찰하고 1point 입법, 토지소유자 당사자 간 합의와 신청에 의한 조정, 분할합병방식이 아닌 경계조정방식, 한시법 적용의 4가지 원칙에 따라 토지경계조정에 관한 특별법(안)을 제정할 것을 제안하였다.
Abstract
Currently, the laws related to parcel arrangements implemented in Korea are based on the method of designation of business districts. Therefore, it is limited to apply to small parcels with small area. In this study, we addressed the problem of small scale land divide and suggested a way to adjust the irrational land boundaries through a simpler method called boundary adjustment.. For this purpose, we proposed to enact a special law which specifies the land boundary adjustment and rearrangement shall take place given that the interested parties to find mutual agreement according to the 4 fundamentals such as one point legislation, readjustment according to the consensus and application of land owners, boundary readjustment method intended of division and merger method and application of law with expiration date.
