FTA与知识产权本属于两个不同的领域, 前者属于自由贸易领域, 后者属于知识产权领域, 它们分别在各自的领域内发挥作用. 但是随着贸易与知识产权的发展, 特别是WTO的TRIPS协议的签署, 贸易与知识产权发生了紧密的联系. 由此, 作为区域自由贸易协定的FTA也与知识产权发生了密切的联系. FTA中的知识产权问题, 特别是FTA与知识产权关系的协调问题, 将最终影响FTA谈判的进程和结果, 因此成为FTA缔约方关注的重点问题之一. 本文旨在对FTA与知识产权关系的协调问题进行分析和探讨, 希望以此促进FTA谈判的顺利进行.
Abstract
FTA and IPR belong to two different fields. The former belongs to free trade area, the latter belongs to the field of IPR, and both play a role in their respective fields. However, with the development of trade and IPR, especially the TRIPS of WTO signed, the close relationship between FTA and IPR occurred. Then, as regional free trade agreement, FTA also contacted with IP. The problem of IP in FTA, especially the coordination between FTA and IPR will affects the process and result of FTA, became one of the key issues concerned by the parties. This paper aims to analysis and discuss on the coordination of relationship between FTA and IPR, in order to promote the FTA negotiations smoothly.
