몽골 문화유산 보호 법체계 변화 연구－민주화 혁명 이후(1992~2001년)를 중심으로－

몽골은 1924, 1940, 1960, 1992년 등 총 4차례에 걸쳐 헌법을 개정하였으나 그 안에는 문화유산 보존 등과 관련한 내용을 담지 않았다. 다만 형사법, 민사법 및 기타 관련 법령에서 문화유산과 관련한 일부 조항들이 언급하거나 명시하였을 뿐이다. 한 국가(사회)가 제정·운영하는 문화유산 관련 법률과 제도는 문화유산에 대한 조사와 연구, 보존·보호하는 것으로 종결되는 것이 아니라 해당 국가 내의 민·형사법, 또 국가간 조약 및 협약 등과도 복잡하게 연계되어 있다 이동기, 「중국의 문화재 보호 관련 법률 체계 연구」, 법학논총, vol.23, no.2, 통권75호, 2011, 163∼164쪽 . 따라서 한 국가의 문화유산 관련 법령과 정책의 변화를 온전하게 파악하기 위해서는 전체 기간을 아우를 수 있는 통시적 고찰이 필요하다. 다만 다만 전고 T.에르덴척트, Z.Ninjbadgar, 이정수, 「몽골 문화유산 보호 법체계 변화 연구」, 몽골학, 제75호, 2023, 153∼179쪽 에서도 언급하였다시피 몽골은 1900년대 이후 군주제에서 공산주의 사회 체제를 거쳐 민주주의 사회 체제로 변화하는 과정을 거치고 또 각 체제에 부합하는 법 체계를 제정·시행하여 왔기 때문에 이를 통시적으로 살펴보기에는 어려움이 있다. 따라서 본고에서는 군주제 이후 출범한 사회주의 체제 기간의 문화유산 법 체계의 변화를 다룬 전고에 이어 1992년 민주화 혁명 이후부터 2001년까지의 시기를 대상으로 하고자 한다. 이 시기는 민주주의 시기이기는 하나 전체적인 사회상은 기존의 사회주의 시스템을 상당 부분 그대로 유지하고 있어 큰 틀에서 볼 때 사회주의 시스템의 후기로 볼 수 있다. 따라서 이 기간의 문화유산 정책과 법 체계를 검토하는 것은 전체 사회주의 국가들의 문화유산 보호 및 보존과 관련한 법률과 제도의 변화상을 비교 연구할 때 도움이 될 것으로 생각된다. 이와 함께 사회 체제가 온전하게 민주주의로 전환한 것으로 볼 수 있는 2002년 이후에 대해서는 별도의 논고를 통해 살펴보도록 하겠다.
Abstract
In 1992-2001, legislation of Mongolian cultural heritage protection consisted of the Constitution of Mongolia, international conventions, the Law on Culture and the Protection of Historical and Cultural Monuments, other laws such as the Civil and Criminal Law, and regulations and rules related to the protection of cultural heritage. Before 1990, during the socialist period, the provisions on the protection of cultural heritage were not clearly included in the Constitution and other laws of Mongolia. Only the "Rules on the Preservation of Antiquities" approved in 1924 and repealed in 1940, the "Rules on the Preservation of Antiquities" approved in 1941 and repealed in 1970, and the "Law on Protection of Cultural Heritage of the People's Republic of Mongolia" approved in 1970 and repealed in 1994 regulated issues related to preservation and protection of cultural heritage. Mongolia abandoned the socialist society in 1990 and made reforms in the legal framework. Connected this reform, there has been a change in the legal ideas and system of preservation and protection of cultural heritage. In 1992, the Constitution of Mongolia was redrafted in line with the changes in the social system, and for the first time, provisions on preservation and protection of cultural heritage were included in it. In line with the spirit of the newly approved Constitution, one of the new laws and legal acts is the Law on the Protection of Historical and Cultural Monuments passed in 1994. Also, in 1996, the Law on Culture was approved for the first time, and provisions related to preservation and protection of historical and cultural monuments or cultural heritage were included in it. Also, the Civil and Criminal Laws have been reformed, and provisions related to preservation and protection of cultural heritage have been specifically included. In addition, since 1990, Mongolia has actively joined the international convention for the protection of cultural heritage.
