Abstract
The Fourth Amendment to the United States Constitution protects individuals from government intrusion into individual privacy rights, such as unreasonable searches and seizures. There are numerous US supreme court cases on the warrant requirement of the Fourth Amendment. Individual privacy concerns arise when the police or any other government agent uses new methods of technology without a warrant to collect information in which an individual has a reasonable expectation of privacy. On June 27, 2019, the U.S. Supreme Court decided Mitchell v. Wisconsin, holding that the exigent-circumstances exception to the Fourth Amendment’s warrant requirement almost always permits a blood test without a warrant when a breath test is impossible. The Court held that “when a driver is unconscious and cannot be given a breath test, the exigent-circumstances doctrine generally permits a blood test without a warrant.” Mitchell v. Wisconsin(2019) is a landmark US Supreme Court case which decides whether a warrantless blood withdrawal from an unconscious driver is permissible. There are similar Korean Supreme Court cases which decide whether blood withdrawal from an unconscious driver without warrant is legitimate. This paper reviewed the recent US Supreme Court case, Mitchell v. Wisconsin (2019), regrading the constitutionality of the blood draw without warrant in comparison with several Korean Supreme Court cases. The author of this paper argues that legislation, which reflects the exigent circumstances of blood withdrawal from an unconscious driver, is needed in Korea to authorize the timely collection of evidence.
