Abstract
Despite of the fact that the constitutional doctrine on right to a speedy trial is still a vague concept and it is recognized as an empty content without specific provisions, it is an important area that requires detailed discussions and arguments to comply with the principle in a situation where delays in trial are widespread. Since the procedural fundamental right guaranteed by the constitution requires a detailed discussion on how to apply it in individual cases for its concrete realization, I would like to briefly summarize the significance of the principle of prompt trial and make it a direction to be considered comparatively through research under U.S. law. In addition, the problem of delay in trial, which violates the Doctrine, is not just a problem in the trial process, but a problem that must be applied and resolved extending to the investigation process. I think it is necessary to consider which cases correspond to delay in trial and what kind of sanctions are needed if they correspond to delay in trial. In addition, the current legal system is considered to be an overburdened system that actually presupposes a delay in trial. At first glance, an increase in the number of judges handling this may be one way to resolve this delay, but it seems to be only a stopgap measure to overcome the reality of the violation of this principle. In order to recognize and realize the principle of a quick trial in criminal proceedings as the basic rights of the people rather than an empty cry presented in the Constitution, I think serious considerations for rapid and faithful case investigation and hearing should continue from the investigation and prosecution stages, which are components of criminal proceedings.
