정신질환자 위기서비스체계 구축을 위한 정신건강복지법제 개선방안에 관한 연구

초록

본 연구의 목적은 정신질환자 위기서비스체계 구축을 위한 정신건강복지법제 개선방안을 제안하는 것이다. 이러한 목적을 달성하기 위해 정신건강 위기개념과 국내외 위기서비스체계 관련 법제 및 선행연구를 검토하고, 지역사회에서 정신질환자 위기지원관련 업무를 수행하는 동주민센터 공무원 및 정신건강복지센터 실무자, 정신질환자 가족의 위기지원 경험을 질적 연구의 방법으로 분석하였다. 그리고 조사와 분석결과를 종합하여 정신건강 위기서비스체계 구축을 위한 정신건강복지법제 개선방안을 다음과 같이 제안하였다. 정신건강복지법령의 개정이 요구되는 사항은 다음과 같다. 첫째, 정신건강 위기상황에서 정신건강복지센터, 경찰 그리고 소방관서 등의 공적 기능이 활성화되기 위해서는 「정신건강복지법」의 응급 개념을 확장할 필요가 있다. 둘째, 정신건강복지체계에서 정신질환자의 위기상황에서 당사자 권익옹호와 사회적 안전 확보를 위한 정책을 구체화하기 위해서는 응급개념보다 넓은 범주의 정신건강 위기개념을 신규 입법할 필요가 있다. 셋째, 지역사회 위기서비스 인프라로서 위기쉼터 설치의 근거가 마련되어야 한다. 그리고 정신건강복지법령에 근거한 위기서비스제도 개선방안은 다음과 같다. 첫째, 정신건강 위기와 관련하여 출동한 경찰관과 정신건강복지센터 종사자에 대하여 후속조치를 의무화할 필요가 있다. 둘째, 경찰과 정신건강복지센터 그리고 동주민센터 간의 실효성이 있는 협력체계를 구축하여야 한다. 셋째, 야간 위기서비스체계가 수립되어야 한다. 넷째, 정신건강복지센터는 정신건강상의 위기지원체계로 기능을 확대하여 위기서비스체계의 거점으로 재정립될 필요가 있다.

Abstract

The purpose of this study is to propose a plan to improve the mental health welfare legislation to establish a crisis service system for the mentally ill. In order to achieve this goal, the concept of mental health crisis, domestic and international crisis service system related laws/policy and precedent studies are reviewed. And The crisis support experience of the public officials of community centers, the staff at mental health welfare centers, and the family of people with mental illness was analyzed as a qualitative research method. And, by synthesizing the survey and analysis results, the following directions were proposed to improve the mental health welfare legislation to establish a mental health crisis service system. Matters requiring revision of the Mental Health Welfare Act are as follows. First, it is necessary to expand the emergency concept of the Mental Health Welfare Act in order to activate public functions such as mental health welfare centers, police, and fire departments in mental health crisis situations. Second, in the mental health welfare system, it is necessary to legislate a concept of mental health crisis that is broader than the concept of emergency in order to materialize the policy for protecting the rights of the person concerned and securing social safety in the crisis situation of the mentally ill. Third, as a community crisis service infrastructure, the basis for installing crisis shelters must be legislated. And the improvement plans for the crisis service system based on the Mental Health Welfare Act are as follows. First, it is necessary to make follow-up measures mandatory for police officers and employees of mental health welfare centers dispatched in relation to mental health crises. Second, an effective cooperation system between the police, mental health welfare centers, and community centers should be established. Third, a night crisis service system should be established. Fourth, the mental health welfare center needs to be reestablished as a base for the crisis service system by expanding its function as a mental health crisis support system.
