날씨파생상품(weather derivatives)은 기초자산이 기온, 강우, 강설, 바람 등 기상관련지수에 의해서 표시되는 파생상품이며, 날씨 변동의 위험을 효율적으로 관리할 수 있는 수단이다. 날씨파생상품은 약 10년전 미국에서 냉방 및 난방일수에 기초한 표준기온계약이 도입된 이래 여전히 초기단계에 있지만 최근 혹한, 태양복사 등 새롭고 독특한 날씨파생상품들이 개발되면서 거래량이 지속적으로 증가하고 있다. 이는 날씨 변동에 영향을 받고 있는 우리나라의 기업 등에게 시사하는 바가 크다. 날씨파생상품시장의 활성화를 위해서는 기온, 강우량, 강설량 등 기초자산이 되는 기상지수를 명확하게 정의하고 측정주체, 측정방법 등을 상세하게 규정하여 시장참가자들의 신뢰를 확보하여야 한다. 날씨시장의 수요와 공급을 연결시켜 거래를 성사시킬 수 있는 중개기관이나 애널리스트의 노력이 필요하고, 전문적이고 효율적인 메뉴얼과 파생상품 계약업무에 익숙한 변호사 등 전문가의 양성도 요구된다. 날씨보험 등 보험업계와의 관할 문제도 정리할 필요가 있다. 날씨보험의 기능과 구조는 날씨파생상품과 매우 유사하고 실제로 중복되지만, 서로 다른 규제체계로 인하여 규제차익이 문제되기 때문이다. 실제로 미국의 파생상품업계와 보험업계 사이에서는 날씨파생상품에 대한 관할 문제가 심각하게 논의된 바 있다. 이 글은 우리나라의 날씨파생상품의 도입 및 운영방안을 논의한 것이다. 날씨파생상품의 개념, 종류, 시장현황을 살펴보고, 날씨파생상품과 날씨보험상품을 비교하였다. 또한 주요 국가의 날씨파생상품 규제체계를 살펴보고, 우리나라에서의 도입 및 운영방안을 제시하였다.
Abstract
In recent years, one of the factors that had a significant impact on the economic development was represented by climatic change. At international level, the weather risk management stands for a priority for governments and companies within the industries affected by the weather variability. Weather derivatives are financial instruments that can be used by organizations or individuals as part of a risk management strategy to reduce risk associated with adverse or unexpected weather conditions. The difference from other derivatives is that the underlying asset is rain, temperature and/or snow, etc. The first weather derivative deal was in July 1996 when Aquila Energy structured a dual-commodity hedge for Consolidated Edison Co. After that humble beginning, CME introduced the first exchange-traded weather futures contracts in 1999. This weather derivatives market has expanded to become a $11.8 billion industry by 2011. As markets for weather derivatives have rapidly grown, relevant legal issues emerged from such growth. One of the most difficult legal issues is the relationship with weather insurance. Within this article, we try to address on the matter of weather risk management. This article is structured as follows: Part Ⅱ provides the definition of weather derivatives and current status of weather derivatives market. Part Ⅲ looks at strong similarities and differences between weather insurance and weather derivatives. Part Ⅳ examines regulation of the weather derivatives and the reasons of underlying rationale to the different regulatory regimes. Part V is to propose a scheme for weather derivatives regulation and the method for activating weather derivatives market.
