본 연구에서는 2000년 이동통신사 사용자 이용약관 규제를 시작으로 2014년 ‘이동통신 단말장치 유통구조 개선에 관한 법률’에 이르기까지 이동통신 단말장치(단말기) 보조금 지급에 대한 규제에 대한 이동통신사업자들의 순응 영향요인을 파악해보았다. 규제순응 여부에 영향을 미치는 요인으로는 규제순응 혹은 불응에 따른 기대효용과 비용의 차이를 선정하였다. 사례분석을 통해 규제순응 편익과 비용은 단말기 보조금을 지급함으로써 이동통신시장에서의 점유율을 높일 수 있는 가능성에 좌우되며, 그 기회는 시장의 성장 가능성 혹은 추세, 이동통신 기술 수준 및 그 발전에 따른 새로운 이동통신시장의 진입 여부에 따라 등장하였음을 확인하였다. 이를 바탕으로 5세대 이동통신서비스가 상용화되기 전까지는 단말기 보조금 규제의 재도입 필요성은 낮다는 시사점을 도출하였다.
Abstract
In this study, we examined the factors of compliance of mobile phone subsidy regulation by focusing on differences in expected utility and cost due to regulatory compliance or refusal as factors affecting regulatory compliance. As a factor affecting regulatory compliance, we selected the difference between expected utility and cost due to regulatory compliance or refusal. From 2000 to 2014, we examined the factors affecting the compliance of mobile telecommunication companies with respect to the regulation of subsidies for mobile communication terminal devices. The analysis shows that the benefits and costs of regulatory compliance are dependent on the possibility of increasing market share in the mobile communication market by the handset subsidy. The opportunities are the market's growth potential or market trend, the level of mobile communication technology, And that opportunities emerged as new telecommunication market begins. This suggests that the need to reintroduce handset subsidy regulation is low until the fifth generation mobile communication service is commercialized.
