단기수출보험(선적후-일반수출거래 등) 개정약관에 관한 소고

Abstract

The Short-term Credit Insurance of K-sure offers 88% of K-sure’s insured amounts and its General Terms and Conditions are important providing a solid foundation for all other policy terms of K-sure’s products. Recently on July 17, 2015, the policy terms of Short-term Credit Insurance have been revised a lot reflecting those of Korean commercial law and the policy terms regulation law. The K-sure’s policy terms amendment specifies the standards of exemption from liability (Article 8, 18), expands the range of cost maintenance due to loss protection and mitigation of duty (Article 14), sets up the insurer’s responsibility to issue and explain the policy terms, and establishes protection provisions for policyholder in case of violation (Article 15(2)). Payment of premium becomes more advantageous to policyholder (Article 20). Documents relating to a duty to report upon claims, an insurance claim and a claim settlement have been specified (Article 21, 22, 24). Extinctive prescription of insurance claim and refund request has been made which is more favorable to the policyholder and it also improves the transparency of management. However, it seems to be improved by referring to the terms of Atradius regarding to loss protection, mitigation of duty and execution cost to clarify proportional allotment according to claim amount and administrative costs. It also seems that K-sure needs to take discomfort and cumbersome into consideration when explaining the policy terms to the policyholder. Stating the interest rate of return premium is also necessary. Listing the documents of compensation of Short-term credit insurance online or as an insurance claim form seems sufficient. Referring to the terms of NEXI about extinctive prescription of insurance claim and taking all variables into account -such as perils covered and a duty to report upon accident–to clarify the starting point of reckoning is needed to provide every convenience to the policyholder.
