온라인 대학교육이 활성화되면서 저작권 문제가 대두되고 있다. 온라인 대학에서는 교육목적상 필요하다고 인정되는 경우 관련 기술조치를 취하고 보상금을 지급하는 조건으로 공표된 저작물의 일부분을 복제ㆍ공연ㆍ방송ㆍ배포 또는 전송할 수 있다. 학생은 수업목적상 필요하다고 인정되는 경우에는 공표된 저작물을 복제하거나 전송할수 있는데, 전송은 수업에서의 질의, 과제 제출, 퀴즈 응시 그 밖의 시험 응시 등에서 필수적이다. 온라인 대학교육에서는 시험이 보통 온라인으로 치러지기 때문에 시험문제로서 저작물 이용에 전송을 포함시킬 필요가 있다. 최근 문제되고 있는 디지털 글자체는 판례상 컴퓨터프로그램저작물로 저작권이 인정되거나 디자인보호법상 디자인권으로 인정되고 있다. 디지털 글자체를 포함한 컴퓨터프로그램의 경우 이를 교육목적이건 사적이용이건 교재개발이건 자유이용이 어렵다. 이 점에서 디지털 글자체에 대해 예외적으로 다른 저작물처럼 교육목적을 위하여 또는 시험문제에서 자유이용이 가능하도록 저작권법을 개정하여야 한다.
Abstract
Cyber or Online Universities may reproduce, distribute, perform publicly, broadcast, or conduct interactive transmission a part of a copyright work already made public to the extent deemed necessary for the purpose of classroom education under the compensation to the author. If universities conduct interactive transmission, the necessary measures including reproduction prevention measures shall be taken in order to prevent infringement on copyrights and other rights. Students may reproduce or interactively transmit a work already made public to the extent deemed necessary for the purpose of classroom education. Transmission of a work is inevitable in the online classroom for interactive question & answer, report, quiz and examination. Copyright Act should be amended to permit transmission of a copyright work already made public in examination. Digital font is deemed as a computer program or design in korea. Computer program including digital font cannot be reproduced, distributed or transmitted without author’s permission. Copyright Act should be amended to permit reproduction, interactive transmission of a digital font already made public for the purpose of online education..
