본고에서는 현존하는 19세기 말 檢案 중 여성들의 일상적인 수다가 두 여인의 사망사건으로 비화된 이른바 ‘淮陽郡 長陽面 검안’을 통해서 당시 평민 여성들의 삶을 살펴보았다. 江原道 淮陽郡 長陽面 上新院里 日耕洞이라는 외딴 산골에서 발생한 이 사건은 여인네들이 디딜방아로 쌀을 찧는 자리에서 퍼진 음행의 추문이 그 발단이 된다. 이로 인한 시비에 휘말려 임신한 文召史가 구타당한 날 밤에 숨졌고, 이에 대한 보복으로 문조이의 남편과 아들, 시동생이 문조이를 구타한 朴召史를 때려죽인다. 추문이 살인으로 비화되는 이 사건을 통해서 일반적으로 사료에 잘 드러나지 않는 평민 여성들의 일상적 삶, 특히 향촌 내에서의 사회생활을 엿볼 수 있다. 따라서 회양군 장양면 사건은 여성사적 관점에서 주목할 만한데, 특히 추문에 대한 평민 여성들의 반응을 통해서 유교 이데올로기에 의거한 여성성의 사회적 통제와 감시가 양반층뿐만 아니라 평민층에서도 상당한 정도로 이루어졌음을 살펴볼 수 있다. 한편 회양군 장양면 사건은 문조이의 사망원인이 구타치사인지, 아니면 음독자살인지를 규명하는 문제가 쟁점이 되어 初檢과 覆檢, 1, 2, 3차에 이르는 査案에 이르기까지 5차에 걸쳐서 사건 조사가 상당히 복잡하게 진행된다. 결국 사건의 진실은 명백하게 밝혀지지 않았음에도 불구하고, 조사 과정에서 검시 결과의 조작과 위증 및 자백의 강요 등이 있었을 가능성이 짙다. 따라서 본고에서는 검안이라는 보고서 양식 아래 은폐된 진실을 밝혀내기 위해서 檢査官 뿐만 아니라 원고와 피고, 증인 등이 활용한 수사학이나 전략에 대한 심층 분석을 시도했다.
Abstract
The main focus in this article lies in the analysis of an inquest record or kŏman from the late nineteenth century. The so-called "Case of Changyang Village, Hoeyang County 淮陽郡 長陽面 檢案" reveals the nineteenth-century commoner women's village life that has not been found in any other historical materials. In this case, two neighboring women's deaths were caused by a slanderous rumor on adultery. The story that Kim Choi 金召史 committed adultery with a rich elite man living in the same village was told while neighbor women pounding rice in Mun Choi's 文召史 house. Kim Choi's mother Pak Choi 朴召史 who thought Mun Choi made up the vicious story about her daughter Kim Choi quarreled with Mun Choi and finally hit her. At night Mun Choi who was pregnant suddenly died after suffering from severe pains. Mun Choi's husband who believed Pak Choi caused Mun Choi's death went to Pak Choi's house and bit her to death along with his eleven-year-old son and younger brother. A slanderous rumor caused two neighbor women's deaths. This case seems to interest us from the perspective of women's history in that it sheds light on nineteenth-century commoner women and their village life. In particular, the commoner women's reactions to slanders of their sexual integrity show how prevalent the social control and discipline of female sexuality based on the Confucian ideology was in society regardless of social status. The investigations of this case were conducted five times in order to determine whether Mun Choi's death was caused by beating or poisoning. Mun Choi's family claimed that the autopsy report was not only fabricated under the order of the district magistrate but also torture was used to extract confessions from the defendant and witnesses. In this respect this article also attempts to analyze the rhetoric appropriated by the defendant, plaintiff, and witnesses at the law court.
