본 연구는 산지의 정의와 관련한 기존 학설이 타당한지를 검토하고, 산지의정의와 관련한 제반 문제점을 분석하여 개선방안을 제시하기 위한 것이다. 연구결과, 현재 산지관리법 상 산지의 정의와 관련하여 기존의 임총설, 목적설외에 현황설이 추가되어야 한다는 점을 밝혔다. 아울러 산지의 정의와 관련하여 법령 간 상충 등 여러 가지 문제점을 정책고객 및 행정적 문제점과 법률적문제점으로 구분하여 도출하였다. 따라서 이러한 문제를 해결하기 위한 정책방안으로 산지의 정의를 지목설로 전환하고, 지목의 현실화를 위한 필지분할등 공간정보의 구축 및 관리 등에 관한 법률 개정과 함께 국토의 64%인산지의 현황을 반영하기 위한 지목세분화 필요성을 제시했다. 이번 연구를 기회로 앞으로 산지의 지목 세분화 등 다양한 연구가 이루어지는 계기가 되었으면 한다.
Abstract
The study reviews validity of existing theories in defining the term “mountainous districts,” analyzes the surrounding problems arisen from it and proposes improvement measures. The study findings indicate that in relation to the current definition of Mountainous District, Status Quo Theory should be added to the existing Collectively Standing Timber Theory and Purpose Theory. The study draws its conclusion by dividing policy customers with administrative and legal ones, considering problems such as conflicts between laws. The study suggests first to convert the current definition of “Mountainous District” to Land Category Theory, second to revise Law on establishing space information and management for the purpose of dividing land by rationalizing Land category, and finally to departmentalize Land Category in order to reflect the fact that 64% of Korean territory is mountainous district. The conclusions of this study are to be an opportunity for other various studies to diversify land category of Mountainous District.
