한국 장기이식 거버넌스의 변화: 협력적 거버넌스의 가능성

초록

본 연구는 한국 장기이식 거버넌스의 변화를 분석하였다. 분석 결과를 요약하면 다음과 같다. 첫째, 이식법이 제정되기 이전 네트워크 거버넌스 아래에서 뇌사의 법적 인정이라는 쟁점의 해결을 위해 계층제 거버넌스의 필요성이 강조되었다. 둘째, 이식법 제정 이후 장기이식 전반에서 네트워크 거버넌스의 역량은 과소평가되고, 과도한 계층제 거버넌스로의 변화가 발생하였다. 셋째, 이식법 제정 이후 문제시 되어온 장기기증 및 이식의 감소를 해결하기 위한 방안으로 협력적 거버넌스로의 변화가 나타났다. 협력적 거버넌스로의 변화로는 장기기증자에 대한 비가격적 인센티브(시장 거버넌스) 도입과 관련 기관 간 수평적･자발적 협력(네트워크 거버넌스)을 활성화하기 위한 뇌사추정자 신고의무(계층제 거버넌스) 도입 등을 들 수 있다. 이상의 분석을 통해 본 연구는 한국 장기이식 사례로부터 협력적 거버넌스로의 변화와 협력적 거버넌스의 가능성을 확인하였다.

Abstract

This study analyzed the changes in organ transplantation governance in Korea. The results of the analysis are summarized as follows. First, under the network governance before the transplantation law was enacted, the necessity of hierarchical governance was emphasized to solve the issue of legal recognition of brain death. Second, since the enactment of the transplantation law, the capacity of network governance has been underestimated and the transition to excessive hierarchical governance has occurred. Third, there has been a change to collaborative governance as a way to solve the problem of organ donation and transplantation that have been problematic since the establishment of transplantation law. The changes to collaborative governance include the introduction of non-price incentives for organ donors (market governance) and the introduction of a duty to report the patients who are presumed to have brain death (hierarchical governance) to promote horizontal and voluntary cooperation among related institutions (network governance). From the case of Korean organ transplantation, this study confirmed the change to collaborative governance the possibility of collaborative governance.
