2019년 11년차를 맞이한 법학전문대학원에서 시도되었던 법학 교육 과제들 중 가장 새롭고 도전적인 것은 리걸 클리닉 교육이었다고 생각한다. 리걸 클리닉 교육은 실무교육을 넘어 법을 통한 사회봉사를 경험하게 함으로써 자연스럽게 윤리적 법조인을 양성하는 기회를 갖는다. 법조윤리교육의 측면에서도 매우 매력적이며 법학전문대학원법에서 지향하는 로스쿨 출범의 취지와도 부합한다. 그러나 현재 리걸 클리닉 교육은 로스쿨이 직면한 여러 법학 교육의 과제들과 마찬가지로 여러 측면에서 시행착오를 겪고 있고, 법적․제도적 개선방안들을 해결하지 못한 채 변호사시험이라는 숙제 앞에서 무기력하게 유지되고 있다. 과연 3년이라는 로스쿨 교육 과정 속에서 리걸 클리닉 센터로 집중되는 임상법학의 바람직한 모습은 무엇인가? 이 연구는 리걸 클리닉 교육이 당면한 현실을 해결하고 리걸 클리닉 교육의 활성화를 위한 발전방안을 제안하고자 한다. 먼저 한국의 리걸 클리닉 교육이 걸어온 지난 10년 동안의 과정을 “Ⅱ. 리걸 클리닉 교육 10년의 과정과 문제점”라는 목차로 개관한다. 리걸 클리닉 교육이 직면한 문제점을 ‘리걸 클리닉 교육의 형해화가 빚은 교육적 격차’의 측면에서 그 심각성을 공유하고자 한다. 이어서 “Ⅲ. 로스쿨 간 협력을 통한 리걸 클리닉 교육의 발전 방안”을 제시하고 Ⅳ.에서는 리걸 클리닉의 제도 개선 과제의 하나로서 ‘법원학생실무규칙’의 제정을 통한 ‘형사 국선변호 리걸 클리닉’의 실시를 제안한다. 앞으로 지난 10년의 시행착오를 바탕으로 로스쿨 간 협력을 통하여 활성화된 리걸 클리닉 교육이 미래 법학교육의 중심으로 자리 잡고 법학교육의 전기가 되기를 기대한다.
Abstract
Clinical Legal Education was the newest and most challenging of the legal education tasks attempted at Korea's law school. It allows students to go beyond practical legal education and experience community service through law. Law students have the opportunity to develop ethical lawyers. This is very attractive in terms of legal ethics education and is consistent with the intent of Article 1 of the rule on law school. However, clinical Legal Education, like many projects of legal education tried at law schools, has been trial and error in many respects. Over the past decade, legal and institutional challenges about legal clinic have been drift unsolved before the immediate homework of the bar exam. What are the desirable aspects of clinical legal education in Korea? This study proposes development plans for revitalizing clinical legal education to solve the reality of lawmaker education. First, I review the process and problems of 10 years of Korean clinical legal education (Ⅱ. Clinical Legal Education of 10 Years and Challenges). I explain the problems in terms of the educational gap between law schools. Then, I suggest the ways to develop clinical legal education through cooperation between law schools(Ⅲ). Lastly, I propose the implementation of the Criminal Defense Legal Clinic through the enactment of the Practice Rule of court for law students(Ⅳ). I look forward to future clinical legal education as the center of law education and to become a turning point of Korean law education.
