프랑스 법률가 양성제도와 그 시사점 — 사법법원(Juridiction judiciaire)의 사법관(Magistrat)과 변호사(Avocat)를 중심으로 —

2007년 법학전문대학원 설치･운영에 관한 법률이 제정되어 2009학년도부터 도입된 법학전문대학원의 교육이념은 국민의 다양한 기대와 요청에 부응하는 양질의 법률서비스를 제공하기 위하여 풍부한 교양, 인간 및 사회에 대한 깊은 이해와 자유･평등･정의를 지향하는 가치관을 바탕으로 건전한 직업윤리관과 복잡다기한 법적 분쟁을 전문적･효율적으로 해결할 수 있는 지식 및 능력을 갖춘 법조인을 양성하는 것이다. 그럼에도 16년차를 맞이한 현재, 교육을 통한 법률가 양성이라는 법학전문대학원의 도입취지와는 다르게 변호사시험이 자격시험이 아닌 선발시험으로 변질되면서 법률가에게 반드시 필요한 기초법학 교육과 전문성과 다양성을 확보할 수 있는 전문법학 교육이 완전히 배제된 채 성찰과 토론을 통한 법학적 사고를 함양하는 것이 아닌 변시 학원화 된 것이 현실이고, 학문 후속 세대의 부족으로 인한 학문으로서의 법학 교육도 함께 위기에 봉착하였다. 이에 교육이념에 부합하는 법률가를 양성하기 위한 개선방안에 대한 연구의 필요성이 크다. 이러한 문제의식을 바탕으로, 프랑스의 사법법원의 사법관과 변호사 양성제도를 살펴보았다. 프랑스 제도의 특징은 사법관 양성제도와 변호사 양성제도가 분리되어 있고, 각 양성제도에서 사법관과 변호사의 전문성과 다양성을 확보하는 선발제도와 교육제도를 운영하면서 충실한 법률 교육 및 실무 교육을 시행하고, 변호사시험을 자격시험으로 운영하고 있으며, 이론 교육과 실무 교육을 구별하여 대학에서 학문 후속 세대를 충실하게 양성하고 있다. 한국에의 시사점으로는 법학에 관한 지식을 평가하기 위한 시험 결과를 입학전형자료로 활용하는 방안, 법학전문대학원을 두는 대학에서의 법학과 인정, 교육 기간의 확대 및 기초법학과 전문법학의 필수이수과목 지정, 직무윤리 교육의 강화, 변호사시험 합격자 수의 확대를 통한 자격시험화, 선택형 문형의 개선 등이 있다.
Abstract
The educational ideology of the law school is to cultivate sound professional ethics and legal professionals with the knowledge and ability to resolve complex legal disputes professionally and efficiently based on a wealth of liberal arts, a deep understanding of humans and society, and values aimed at freedom, equality, and justice to provide high-quality legal services that meet various expectations and requests of the people. Nevertheless, in its 16th year, contrary to the purpose of introducing the law school, which is to cultivate lawyers through education, the bar exam has been turned into a selection test rather than a qualification test, and legal education as a discipline has also faced a crisis. Accordingly, there is a great need for research on improvement measures to cultivate lawyers who meet the educational ideology. In France, the judicial training system and the lawyer training system are separated, and each training system conducts faithful legal education, operates the bar exam as a qualification test, and faithfully trains subsequent generations of academics at universities by distinguishing theoretical and practical education. Implications for Korea, the test results to evaluate the knowledge of law can be used as admission data, Universities that have law schools are also allowed to have law departments, expansion of the educational period, improving the curriculum, increase the number of successful lawyers.
