독일의 탈원전 및 원전해체 관련 입법의 법적 쟁점

초록

1960~70년대 원자력 발전(發電)이 도입된 이후 원전산업은 전세계적으로 롤러코스터와 같은 흥망성쇠의 역사를 반복하고 있다. 굴곡진 원전정책의 빠른 변화 속에도 여전히 탈원전 정책을 둘러싼 치열한 법적 논의들과 유효한 결정들이 다양한 함의를 제시하며 고유한 속도로 전개되고 있다. 이에 관한 가장 대표적인 사례는 독일에서 찾을 수 있다. 본고는 변화무쌍한 원전정책의 기후 속에서 진행되고 있는 탈원전 정책의 법제화에 따른 법적 논쟁을 고찰하고, 탈원전 여부와 관계없이 새로운 현안으로 부상한, 원전해체 제도에 내재된 법적 이슈를 독일 사례를 통해 살펴보았다. 구체적으로 본고는 먼저 독일 탈원전 정책의 발전 과정을 검토하였다. 이 치열한 과정의 맥락을 전체적으로 조망할 수 있도록 역사적 관점과 정치적 관점에서 탈원전 논의의 전개 과정을 살피고, 탈원전 입법의 발전 과정을 검토하였다. 다음으로 2011년 3월 11일 발생한 후쿠시마 원전사고의 여파로 제정된 2011년 탈원전 법률(제13차 개정 원자력법)에 대하여 재산권 보호를 주장하며 제기한 원전사업자들의 불복사건에 대한 연방헌법재판소 결정과 그 연장선에서 문제가 되었던 제16차 개정 원자력법에 대한 연방헌법재판소 결정의 주요 내용을 분석하였다. 또한, 원전의 단계적 폐지가 결정된 이후, 독일의 국가 원자력 정책의 우선순위 중 하나가 된 원전해체에 관한 독일의 법제도 형성 과정과 주요 내용을 검토하고, 원자력법의 원전해체허가 근거 규정을 둘러싸고 발생한 법적 문제에 대한 연방행정법원의 판단을 검토하였다.

Abstract

Since the introduction of nuclear energy in the 1960s and 1970s, the nuclear industry around the world has achieved a history of ups and downs like a roller coaster. Despite the rapid change of the curved nuclear energy policy, heated legal debates and litigations surrounding the nuclear phase-out policy are still developing at a unique pace, offering various implications. The most representative example of this can be found in Germany. This paper examines the legal debates over the legislation of the nuclear phase-out policy under the ever-changing climate of nuclear policies, and examines the legal issues inherent in the nuclear dismantling and decommissioning system, which has emerged as a new issue regardless of a political landscape of the nuclear energy policy. Specifically, this paper first reviews the development process of Germany's nuclear energy policy. In order to understand the overall context of this process, both the historical and the political developments are observed followed by an examination of the evolution of the German nuclear law. Next, the Federal Constitutional Court's judgment on the complaint of nuclear operators against the 2011 Nuclear Phase-out Act (the 13th amendment of the Atomic Energy Act) enacted in the aftermath of the March 11, 2011 Fukushima nuclear accident is analyzed. Lastly, the German legal framework on the dismantling and decommissioning licensing scheme, which has become one of the priorities of the recent German national nuclear policy, is reviewed along with analyses of the Federal Administrative Court's judgment on its interpretation.
