The article look into the newly adopted Protocol of 2002 to the Athens Convention relating to the Carriage of Passengers and their Luggage by Sea, 1974. It considers first the history and the background of the Convention and the Protocol as a person actively involved in its formation. It analyses next the basis of liability raising doubts about the rule that all victims of shipping incidents may rely on strict liability whereas other victims must show the fault or negligence of the carrier. It also explains a compulsory insurance scheme newly adopted to back up the liability scheme. It also explains how the limits adopted in the Protocol were reached and what are the rationals justifying the limit
