개항질서법 제25조 및 제26조에서는 개항의 항계안 및 항계밖 10킬로미터이내의 수면에 선박의 안전운항을 해할 우려가 있는 해양사고의 경우 조치 및 장해물의 제거 등에 대해 규정하고 있다. 이 규정들은 또한 해양환경관리법, 해상교통안전법, 항로표지법 및 공유수면관리법에도 규정되어 있다. 그러나 개항질서법에서의 이러한 규정들은 다른 국내법과 다르게 규정되고 규제함으로 인해 이 법을 준수하고 집행하는 자들에게 일부 문제점을 야기하고 있다. 본 논문의 목적은 개항질서법상 해양사고의 조치 및 장해물의 제거에 관한 문제점을 제시하고, 향후 법 개정을 위한 방향을 제안하고자 함에 있다.
Abstract
In the Article 25 and 26 of the Open Port Act, it is prescribed that appropriate measures shall be taken in case a marine accident is occurred and any obstacle which may be harmful to the safe navigation of vessels or to the safety within harbor limit and 10 kilometers from the harbor limit of the open port shall be removed. The same requirements with this provision are also prescribed in the 「Marine Pollution Prevention Act」, 「Maritime Traffic Safety Act」, 「Navigational Aids Act」 and 「Public Water Control Act」. However, it gives rise to inconsistency in the observance of these requirements by observers, as the Open Port Act prescribes the requirement in different ways from other national Acts on the same requirements for preserving the channels. This study aims at the research on the discrepancies between those relevant provisions of the Acts and the suggestion of amending the provisions of the Open Port Act in the future, so as to avoid inconsistency for observers.
