중국의 해양환경보호법제에 관한 연구

우리나라와 인접한 중국은 최근 괄목할만한 경제성장을 하고 있다. 그러나 그 부작용으로 인하여 심각한 환경오염문제가 대두되고 있으며, 특히 대부분의 오염물질이 유입되는 해양의 경우에는 더욱 그러하다. 그러므로 중국의 해양오염법제에 대한 연구는 중국은 물론 우리나라의 해양을 비롯한 환경보호에도 적지 않은 영향을 줄 것으로 생각된다. 이러한 의미에서, 1982년에 제정되고 2000년에 개정된, 중국해양환경법을 비롯한 관련법규에 대하여, 우선 내용을 파악하고, 그 시행의 현황 및 문제점, 그리고 개선방안을 중심으로 고찰하고자 한다. 중국의 해양환경의 보호와 개선은 경제발전과 환경에 대한 국제동향에 따른 시의적절한 법제도의 개정과 그 효과적인 시행 그리고 관련부서의 체계화 등이 이루어져야 기약될 수 있을 것이다.
Abstract
Lately the economic growth of PRC(People’s Republic of China) which is next to Korea is rapid. On the other side of its effect, PRC has serious problems of pollution, especially sea into which most pollutants flow. The study on PRC’s Maritime Environmental Law results on useful effects to PRC itself and Korea’s environmental protection including sea. I will research on Laws and Regulations on PRC’s maritime environmental protection: the contents, the achievements and problems in enforcement, and the future prospects. The protection and improvement of maritime environment in PRC can be achieved when PRC amends its legal systems time-properly, enforces effectively, and reconstructs the mechanism in authority.
