영국요트보험약관에 있어서 요트보험자의 보상책임에 관한 해석론적 고찰

국민소득의 증대와 주 5일 근무제가 확대됨에 따라 국민들의 해양레저활동의 수요는 점점 증가할 것으로 기대된다. 특히 2005년 10월에 한국형 세일링 요트가 개발되어 2006년부터 일반국민에게 보급될 예정이며, 최근에 경기도는 요트와 보트 등과 같은 해양스포츠를 즐길 수 있는 레저항을 개발할 계획이다. 앞으로 요트를 이용한 해양레저활동은 일반 국민에게 확산될 것으로 기대된다. 요트를 이용한 해양레저활동이 확대되면 요트의 운항으로 인하여 발생하는 사고도 증가한다. 따라서 요트를 이용한 해양레저활동을 활성화하고, 요트를 이용하는 자가 안심하고 해양레저활동을 할 수 있도록 보장하는 것이 요트보험이다. 그러나 현재 우리 나라에는 요트보험이 없다. 따라서 이 논문은 영국협회요트보험약관에 있어서 요트보험자의 보상책임에 관하여 해석론적으로 고찰하고, 그 결과를 향후 우리 나라 요트보험약관을 제정, 시행하는데 있어 필요한 법적 기초자료를 제공하는 것이 목적이다.
Abstract
There are high hopes of the nation’s marine leisure activities in demand following the increased national income and the 5 day work week system. Especially, the Korean type Sailing Yacht, which was constructed in September 2005, is expected to come into use to the public. Also, a leisure port in which people can enjoy marine sports such as yachts and boats, will be developed in Kyeonggi Province.It is expected that the marine leisure activities with yachts are going to be spread out to the public. Unfortunately, the increase of marine leisure activities will bring on yacht accidents accordingly. Therefore, to promote the marine leisure activities and secure yachtsmen against accidents is what the Yacht Insurance is for. However, we are in the absence of the Yacht Insurance.This thesis will contain the study of the insurer’s liability of indemnity under Institute Yacht Clauses from the interpretative point of view and provide some legal basic materials for the prospective establishment and enforcement of Korean Standard Yacht Insurance.
