국제무역거래상의 환어음에 관한 법적ㆍ실무적 고찰

국제무역거래에서 환어음이 개입하는 결제방식으로 신용장과 추심결제방식이 있다. 이러한 방식에 사용되는 換어음(bill of exchange)은 수출자가 수입자에게 채권 금액을 지명인 또는 소지인에게 무조건 지급할 것을 위탁하는 형식의 유가증권이다. 환어음의 국제적 활용에는 적어도 2개국 이상이 개입되며, 따라서 환어음의 국제적 활용에는 여러 가지 편리성이 있지만, 한편으로는 준거법의 차이에서 오는 실무 적용상 문제점이 있다. 따라서 본 논문에서는 환어음에 관한 정확한 이해를 바탕으로 환어음의 효용성 및 실무상 유의점을 법학적․무역학적 관점에서 살펴보았다. 구체적으로는 우리나라 어음법, 국제사법 및 영국 환어음법, 신용장통일규칙 등 국제규범을 기준으로 환어음의 준거법 문제, 환어음의 형식 및 요건문제, 환어음의 국제무역규칙상 서류심사기준 문제, 환어음의 소구권 문제 등을 검토하였다.
Abstract
The most frequent payment methods in which banks are involved are a collection arrangement and payment under a letter of credit. The seller often attaches to a bill of exchange which he has drawn on the buyer the bill of lading to the goods sold. A bill of exchange is an unconditional order in writing, addressed by one person to another, signed by the person giving it, requiring the person to whom it is addressed to pay on demand or a fixed or determinable future time a sum certain in money to or to the order of a special person or to bearer. The applications of bill of exchange in the international transaction bring about some utilities and several practical problems because they are involved more than two governing law and rules. I researched the utilities and practical problems of draft in terms of law and practical methodologies. In the concrete, I researched the examination standards of bill of exchange under the UCP and ISBP and I also pointed out some problems which came from conflicts of law on Bills of Exchange Acts.
