21世紀 中國 海商法의 發展方向

「中華人民共和國海商法」(이하 「海商法」)은 1992年 11月, 제7기 全國人民代表大會 常務委員會 審議를 거쳐 1993年 7月 1日에 效力을 發生하였으며 현재까지 15年 간 施行되었다. 本文에서는 現行 「海商法」의 立法 背景을 뒤돌아보고 그 特徵에 대해 分析한 뒤, 變化하고 있는 國際, 國內 形勢를 감안하여 存在하고 있는 問題點으로부터 出發하여 21世紀 中國 海商法의 發展方向를 檢討해보고자 한다.
Abstract
This article is about the legal analysis on the distinctive character of the Chinese Maritime Law which was introduced in July, 1993, after looking back upon the background of its legislation. In addition, this article tries to focus on the future direction for the improvement of the Chinese Maritime Law along with the consideration of the circumstances and problems of the international and domestic maritime market.
