Abstract
Marine risk in relation to marine insurance is comprised of inclusive perils, excepted perils and uncovered perils. If one of these risks is the cause of the damage, the insurer’s responsibility is able to be determined in a simple way. If however, two or more of these risks occur in close periodical proximity or at the same time, the insurer’s responsibility becomes difficult to determine. England is the country from which the law on marine transportation and marine risk originated. The common law and precedents regarding these areas of law are well developed. Henceforth, majority of countries, including Korea, resort to the standard article of England for the formation of contract in this area of law. An insurer’s responsibility in relation to marine risk can be decided through three branches of views – the conditional view, proximate cause view and the proximate causal relation view. The final view is one that we are familiar through our civil law and commercial law and is also one that will compete with the English law on the proximate cause view. Theoretically, the proximate causal relation view will be given preference over the proximate cause view. Nevertheless, when taking into consideration the characteristic and convenience of the practice of marine transportation and marine risk, the proximate cause view is more effective. The proximate cause view involves the meaning of the proximate causes. It is further divided into five branches of views – ultimate condition view, prime view, inevitable view, naturally prevalent view and the probable view. Of these, in the Ikaria case, Judge Shaw held that the most effective cause is the prime view.
